Permanent Resident Visa

If a foreign national who is intented to stay in Japan on a permanent basis without limitation.

This visa is for a foreign national who is living in Japan continuously and intented to stay in Japan on a permanent basis without limitation. It will take around 6months for the inspection and examination procedures taken by Regional Immigration Bureau. The inspection and examination procedures are getting strict. The applicant will be inspected if the social insurance has been paid timely. The examination procedures for extensions of the period of stay will be different case by case, it is highly recommended to proceed extention through specialists. The advantages of Permanent Residence Visa are as follows:

There will be no limitation for the period of stay, so there is no need for the renewal everytime. (Re-entry Visa is required) There will be no limitation for the purpose of stay, basically you can do all kinds of jobs if it is legal. (Expect for those jobs which are not applicable to foreign national regulated by law).

Once Permanent Residence Visa has been granted, the credibility of the Permanent Residence holder will be highly improved.

It will be very helpful when dealing with your business partner for trade and make a deal. Also, it is easier to make a loan with local banks.

The spouse and child of the Permanent Residence holder, it is easier for them to apply for Permanent Residence Visa.

Guidelines for Permission for Permanent Residence

1. Legal requirements

(1) The person is of good conduct. The person observes Japanese laws and his/her daily living as a resident does not invite any social criticism.

(2) The person has sufficient assets or ability to make an independent living. The person does not financially depend on someone in the society in his daily life, and his/her assets or ability, etc. are assumed to continue to provide him/her with a stable base of livelihood into the future.

(3) The person's permanent residence is regarded to be in accord with the interests of Japan. a) In principle, the person has stayed in Japan for more than 10 years consecutively. It is also required that during his/her stay in Japan the person has had work permit or the status of residence for more than 5 years consecutively. b) The person has been never sentenced to a fine or imprisonment. The person fulfills public duties such as tax payment. c) The maximum period of stay allowed for the person with his/her current status of residence under Annexed Table 2 of the Immigration Control and Refugee Recognition Act is to be fully utilized. d) There is no possibility that the person could do harm from the viewpoint of protection of public health.

※ The requirements (1) and (2) above do not apply to spouses and children of Japanese nationals, special permanent residents or permanent residents, and requirement (2) does not apply for those who have been recognized as refugees

2. Special requirements for 10-year residence in principle

(1) The person is a spouse of a Japanese national, special permanent resident or permanent resident, and has been in a real marital relationship for more than 3 years consecutively and has stayed in Japan more than 1 year consecutively. Or, the person is a true child of a Japanese national, special permanent resident or permanent resident, and has stayed in Japan more than 1 year consecutively.

(2) The person has stayed in Japan for more than 5 years consecutively with the status of long term resident.

(3) The person has been recognized as a refugee, and has stayed in Japan for more than 5 years consecutively after recognition.

(4) The person has been recognized to have made a contribution to Japan in diplomatic, social, economic, cultural or other fields, and has stayed in Japan for more than 5 years.

(5) The person has continuously stayed in Japan for 3 years or more in cases where such person engaged in the activities coming under any of item (xxxvi) or item (xxxvii) of the public notice (Public Notice No. 131 of 1990) specifying the activities listed in the right-hand column of Appended Table I(5) of the Immigration Control and Refugee Recognition Act pursuant to the provisions of Article 7, paragraph (1), item (ii) of the same Act at a public or private organization located within the area of the plan specified in the regional revitalization plan approved under Article 5, paragraph (16) of the Regional Revitalization Act (Act No. 24 of 2005), and these activities are deemed to have made a contribution to Japan.

(6) The person has a total score of 70 points or more based on the points calculation criteria prescribed in the Ordinance to Provide for the Criteria in the Right-Hand Column Corresponding to “Highly-Skilled Professionals as Specified in Appended Table I(2) of the Immigration Control and Refugee Recognition Act” (hereinafter referred to as “Ordinance of the Ministry of Justice”), and comes under one of the following. a. The person who has continuously stayed in Japan as a “Highly-Skilled foreign Professional” for 3 years or more. b. The person who has continuously stayed in Japan for 3 years or more, and who is deemed to have a total of 70 points or more when calculating with reference to the situation at 3 years before the date of the application for permission for permanent residence.

(7) The person has a total score of 80 points or more based on the points calculation criteria prescribed in the “Ordinance of the Ministry of Justice”, and comes under one of the following. a. The person who has continuously stayed in Japan as a “Highly-Skilled foreign Professional” for 1 year or more. b. The person who has continuously stayed in Japan for 1 year or more, and who is deemed to have a total of 80 points or more when calculating with reference to the situation at 1 year before the date of the application for permission for permanent residence.

(Note 1) In these guidelines, for the time being, any person whose period of stay is “three years” shall be regarded as a “person who is allowed to stay up to the maximum period of stay”, as specified in the above Section 1 (3) c).
(Note 2) The “Highly-Skilled Foreign Professional” in the abovementioned 2 (6) a. is a person staying in Japan, who is deemed to have a score of 70 points or more as a result of the points calculation, and the “Highly-Skilled Foreign Professional” in the abovementioned 2 (7) a. is a person staying in Japan, who is deemed to have a score of 80 points or more as a result of the points calculation.

Permanenteng residency visa

Patnubay Tungkol sa Pagpapahintulot ukol sa Permanenteng Paninirahan

1. Mga bagay na kinakailangan sa ibabaw ng batas

(1) May mabuting pag-uugali Sumusunod sa batas, namumuhay ayon sa katayuan sa lipunan ng walang anumang kapintasan bilang isang mamamayan sa araw-araw na pamumuhay.

(2) May sapat na pag-aari at abilidad upang itaguyod ang sariling pamumuhay. Hindi magiging pabigat sa publiko sa araw-araw na pamumuhay, makikita ang pagkakaroon ng matatag na pamumuhay dahil sa tinatanganang pag-aari, abilidad at iba pa.

(3) May pagpapatunay na magiging kapakipakinabang sa bansang Japan ang paninirahan ng permanente ng taong ito. a) Sa karaniwan, kailangan na tuloy-tuloy ng sampung <10> taon o higit pa ang paninirahan sa bansang Japan. Gayunman, kailangan na sa loob ng panahong ito ay may tuloy-tuloy na limang <5> taon o higit pa na pananatili gamit ang working visa o residence visa. b) Hindi pa napapatawan ng anumang multa at pagkakakulong. Isinasagawa ang mga tungkuling pambayan tulad ng pagbabayad ng buwis at iba pa. c) Tungkol sa tinanganang visa sa kasalukuyan, kailangan na tangan ang pinakamahabang panahon ng paninirahan ayon sa annex bilang 2 ng ordinansang ipinatutupad sa Immigration Control and Refugee Recognition Act d)Ipinapalagay na walang idudulot na pinsala sa pampublikong kalusugan.

* Gayunman, kung asawa o anak ng isang Hapon, Permanent resident, o Special permanent resident, hindi na kakailanganing pumailalim sa bilang (1) at (2). Gayundin, kung mayroong refugee recognition, hindi kailangang pumailalim sa bilang (2).

2. Mga eksepsyon tungkol sa karaniwang sampung <10> taon na paninirahan

(1)Kung asawa ng isang Hapon, Permanent resident, o Special permanent resident, kailangan na patuloy na nagsasama ng totohanan sa loob ng tatlong <3> taon at higit pa. Gayundin, kailangan na tuloy-tuloy ang paninirahan ng isang <1> taon o higit pa sa bansang Japan. Kung anak naman, kailangan na tuloy-tuloy ang paninirahan ng isang <1> taon o higit pa sa bansang Japan.

(2)Kung ang visa ay [Long-term resident], kailangan na tuloy-tuloy ang paninirahan ng limang <5> taon o higit pa sa bansang Japan.

(3) Kung mayroong refugee recognition, kailangan na tuloy-tuloy ang panini- rahan ng limang <5> taon o higit pa sa bansang Japan matapos na mabigyan ng recognition.

(4) Sinomang kinikilala ng bansang Japan na may kontribusyon sa larangan ng diplomasya, lipunan, ekonomiya, kultura at iba pa, at naninirahan ng limang <5> taon o higit pa sa bansang Japan.

(5) Sinomang nagsasagawa ng mga gawain na nabibilang sa alinman sa blg. 36 o blg. 37 ng mga itinakdang gawain sa ibaba ng talaan sa 5 ng annex blg. 1 (ika-131 abiso mula sa Ministry of Justice ng 1990) na alinsunod sa pagtatakda ng blg. 24, takda blg. 1 ng artikulo blg. 7 ng Immigration Control and Refugee Recognition Law, sa mga binanggit na pampubliko at pampribadong institusyon na napapaloob sa itinakdang lugar sa plano ng muling pagpapasigla ng komunidad, na inaprubahan alinsunod sa takda blg. 16 ng artikulo blg. 5 ng Local Revitalization Act (ika-24 Batas ng 2005), at kinikilalang may kontribusyon sa bansang Japan sa paggawa ng mga aktibidad na ito, at tuluy-tuloy ang paninirahan ng tatlong <3> taon o higit pa sa bansang Japan.

(6) Sinomang may pitumpung <70> puntos o higit pa kapag isinagawa ang kakulasyon ng puntos na itinakda sa “ordenansa sa pagtatakda ng pamatayan” sa ibaba ng mga trabahong “lubos na bihasang propesyonal” sa talaan sa 2 ng annex blg. 1 ng Immigration Control and Refugee Recognition Law (Tatawaging [Ordenansa ng mga trabahong lubos na bihasang propesyonal] sa ibaba.), at naaangkop sa alinman sa ibaba: (a) Tuluy-tuloy ang paninirahan ng tatlong <3> taon sa bansang Japan bilang isang [Lubos na bihasang tauhang dayuhan]. (b) Tuluy-tuloy ang paninirahan ng tatlong <3> taon sa bansang Japan, at kinikilalang may pitumpung <70> puntos o higit pa, bilang pamantayan, tatlong <3> taon bago ang araw na nagpasa ng aplikasyon para sa pagpapahintulot sa permanenteng paninirahan kapag isinagawa ang kalkulasyon ng puntos na itinakda sa “ordenansa sa pagtatakda ng pamantayan.”

(7) Sinomang may walumpung <80> puntos o higit pa kapag isinagawa ang kalkulasyon ng puntos na itinakda sa “ordenansa sa pagtatakda ng pamantayan,” at naaangkop sa alinman sa ibaba: (a) Tuluy-tuloy ang paninirahan ng isang <1> taon sa bansang Japan bilang isang [Lubos na bihasang tauhang dayuhan]. (b) Tuluy-tuloy ang paninirahan ng isang <1> taon sa bansang Japan, at kinikilalang may walumpung <80> puntos o higit pa, bilang pamantayan, isang <1> taon bago ang araw na nagpasa ng aplikasyon para sa pagpapahintulot sa permanenteng paninirahan kapag isinagawa ang kalkulasyon ng puntos na itinakda sa “ordenansa sa pagtatakda ng pamantayan.”

(Dapat Tandaan 1) Tungkol sa patnubay na ito, kung may tatlong <3> taon na ang panahon ng paninirahan sa ngayon, ituturing na ang panahong ito ay pumapa-ilalim sa binabanggit na [pinakamahabang panahon ng paninirahan] na nakasulat sa [c] ng (3) sa bilang 1 ng naunang pahina.
(Dapat Tandaan 2) Ang [Lubos na bihasang tauhang dayuhan] na nabanggit sa 2 (6) (a) sa itaas ay tumutukoy sa taong may pitumpung <70> puntos o higit pa kapag isinagawa ang kalkulasyon ng puntos, at ang [Lubos na bihasang tauhang dayuhan] naman na nabanggit sa 2 (7) (a) sa itaas ay tumutukoy sa taong may walumpung <80> puntos o higit pa kapag isinagawa ang kalkulasyon ng puntos.
